Movement from Tier 2 (ICT) to Tier 2 (General) and PR

I have spent more than 4 years under Tier 2 (intra company transfer) , now Im getting a Tier 2 (General ) sponsorship. This resulted a gap of 3 months between these two visas. Therefore I would like to know if I can apply for PR once I complete 5 years depsite my movement from Tier 2 (ICT) to Tier 2(General) and also with a break of 3 months between these two visa.

So given the above case , Im I eligible for PR after completion of 5 years ?

No, the ILR clock stopped when you had no leave to enter/remain in the UK.

Hi,

Thanks for your reply. Meanwhile I had Business visa for this period of 3 months which covered this gap , is this OK ?

Business visa is a "visitor visa", and the time spent in UK on a visitor visa counts towards ILR only when applying under long residence.

This said, having a visa in the passport is irrelevant. What you need to prove is that continuity of residence in the UK is not broken during the residential qualifying period.

120 months (10 years) legal stay in the UK.
