Can't switch to Tier 1 any more?

Can't switch to Tier 1 any more?

Hi,

I'm 30 years old, have two Master's (one from a well respected UK university) and a BSc. I work in the UK on Tier 2 (Employer sponsored) for 3 years now and earn 36k. I have more than 14 years of work experience overall.

However, it seems like I'm not able to apply for Tier 1 (Highly skilled) under new rules any more - somehow I score only 70 our of the required 75 points on the calculator.

Is there anything I can do to become eligible (apart from getting 2 years younger of course)? Do you know if there will be any reviews to this points based system, which currently qualifies you only if you have a PhD, earn in excess of 40k and are 29 years old or younger (a direct violation of age discrimination laws by the way)?

Get a new job with 40K+ salary, I am sure it wouldn't be very difficult for someone with Master Degree from reputable UK university and 14 years experience. 36K is rather low for your qualification

People get extra points if they are younger because they are likely to earn less than someone older, if they didn't it could be discriminatory towards older people at the expense of younger people.

Not everyone scores enough points for Tier 1. Frankly, that is the point.

Thanks for your replies.

If I understand correctly, do you mean that the older people get the more they earn? Sounds like an assumption. Any 30-34 year old person has equal chances of earning more or less than any 27-29 year old, especially if we are talking about different countries. So this justification fails.

I am seriously suspecting that Tier 1-2 age requirements violate the 2006 Employment Equality (Age) Regulations. It's the same if they'd give different points depending on sex: if you're a male you get 10 points, if female - 20 (or vice versa). I might be wrong but I don't see any difference between sex and age discrimination. More, you can theoretically change your sex but you can't get younger.

Looks like according to new rules non-EU people with the following are only welcome:

* a PhD degree;
* sole 40k+ salary (around an average HOUSEHOLD income in the UK)
* 29 or younger

Wonder if this is going to be reviewed sometime soon?

You have some suggestions. You are also here on Tier 2 and you can change your job. Hopefully the job you have is safe and therefore even if you cannot get Tier 1 you can stay in the UK.

The rules also appear to discriminate against 18 year olds, how many 18 year olds would score enough points I wonder.

Who knows how the rules will change in the future.

A sticky situation ..I understand. Acoording to me currently it is only the earning part that can change.Following can be the options(if you have not explored them already):

1) You are currently short 4k in the 12 month salary bracket. Can this be covered by any additonal GENUINE earnings that you might have achieved in the last 12 months or may be in consecutive 12 months in the last 15 months

2) Look for some other avenues of earnings in the next couple of months to cover up the deficit and then apply once you have achieved the points.

Please be sure if you are showing any additional earnings it should be GENUINE and supported by documents as per the Tier 1 policies.

Just a 2c worth of input, probably you could do some part time job to earn that extra £4K and close the gap?
This way you'll be able to apply for Tier 1 without applying another job (which I understand not a simple matter for Tier 2 holder), and you don't need to get a PhD.
