I am here on the HSMP visa (extended), valid until March 2009, by when I supposedly should be eligible to apply for Indefinite leave i.e. settlement. I presume by then the new system would be in place and active.
The preliminary draft of the points based system raises a lot of questions and confusions especially for those who are already here on HSMP completing their 4 yrs stay before applying for ILR.
-- If everyone applying for ILR is reassessed against the points, and one does not attain the required points at that stage, would he/she be asked to leave the country inspite of spending 4 years in stable jobs?
The document released yesterday says very very little on how ILR/settlement applications would be assessed under the new rules...
-- I found some aspects of the mooted points system quite bizarre. It's quite amusing when you discover the conclusion being drawn by Mr Clarke is that you don't acquire any SKILLS by virtue of your work experience. So you don't get any points for it. Or have they got the definition of SKILLS something different to what I understand. It seems SKILLS can only be acquired by education and more so if it's from British universities.
-- Although it's quite early to say what the final shape of the new rules could be, how are they expected to affect ILR applications from hsmp visa holders who gain entry under the current rules...
