HSMP - apply from the UK or from outside

Dear Sirs,

My current UK visa expires at the end of August, so I have about 3 months.. What do you think, is it worth to apply on HSMP "from the UK" now, with the hope to get the decision before visa expired?

As soon as I know, further application to FLR has to be made before current leave expires.

Could I apply now as "from the UK", but leave the country in the case of delay of HSMP decision and continue process as from outside the UK, i.e. apply for EC?

I would very much appreciate your help.

It is a student visa.

That is true, visa does allow in-country switching. The problem arises if the HSMP decision is made after visa expired, because I have to make the next step - FLR application - with valid current leave ..

As Chess mentioned, if you apply before your visa expires, your entire stay is legal until the decision is made.

Does this mean that until the decision on FLR is made I will have the same (student) status?

That was definitely true until last changes in the process were made. Now I'm not submitting my passport on HSMP stage, but only for FLR, when HSMP decision is made (3+ months)... And on FLR they ask for valid current leave:)

Hi,

I've just gotten a reply from the Work Permit Team on the same request:

If your visa is expiring then you should submit your passport with the FLR
form before it expires - i.e. before you have your HSMP decision. this does run the risk of you losing the £121 but it will mean that you can stay
legally in the UK.

I wonder, is it OK to apply on FLR without HSMP decision and "run the risk of losing £121"?
