NZer and Brit

Post by sugarpie24 » Fri Jun 18, 2010 5:30 am

Hi, I am a male NZer and my wife has an NZ passport but was born in England so can apply for a British passport. We celebrate our 4th wedding anniversary soon, does that 4 year rule still apply? Thanks :)

She should be able to get a passport at any time, no need to wait 4 years.

You can apply for ILR after 5 years here (WHV/YMS doesn't count) or after 2 years here on a spouse visa.

I doubt you can get a spouse visa until she has her passport though.

The amount of time you have been married is not relevant.

There used to be something about 4 years - if you are married 4 years outside the UK you can immediately get ILR and then apply for residency a few years after that, I have read it on the net just wondered if anyone knew for sure what the current legislation is? Thanks
