uk eu application

hi there i just wanted some advice..........
my husband was here on a visitor visa as we were seperated at the time, him in cyprus myself and son in the uk, whilst visiting here we saw an immigration solicitor, who told us to apply for flr m visa.
we did this and recently received a letter from the home office saying he had applied using the wrong form, that flr o needed completing.
we have done this but i have dual nationality, greek cypriot and british,
i have heard that my husband can stay here for 5yrs as an eu spouse?
can someone give me some details on this?

Your husband has the right of residence in the UK as the family member of a Cypriot national who has acquired the right of permanent residence in the UK.

Assuming your husband is physically still in the UK (from your post it is not clear), he should apply using form EEA2 for a "Residence card of a family member of a Union citizen", making explicitly clear that he is a family member of a Cypriot national who has acquired the right of permanent residence in the UK. No mention of your UK nationality is required. Your husband's Residence Card must be issued within six months of application.

Incidentally, when did your husband come to the UK?

he came in december but he was on a visitor visa as he is from non eu country.
we applied for flr m but we were told that he has to apply for discretionary leave FLR O.
that application is with the home office, but we want to apply as eu spouse

Simply submit an application for a "Residence card of a family member of a Union citizen", making explicitly clear that he is a family member of a Cypriot national who has acquired the right of permanent residence in the UK. No mention of your UK nationality is required.
