EEA4 with sponsor working in other EU country?

Post by quickquestion » Sun Jun 20, 2010 1:39 pm

I haven't found any information on this yet.

Consider the case of Non-EU family member applying for EEA4, shares family home in the UK with EU spouse who works in other EU country (e.g. spends weekdays in Europe and weekends in the UK). Does the non-UK employment of the sponsor qualify the non-EU spouse for EEA4 residency?

Can the non-UK employment be put under sponsor exercising treaty rights in the UK under 'employment' or is it 'self-sufficiency' via employment outside the UK?

They are considered as frontier workers. They are slightly different from self sufficient
person in the sense that they are not strictly speaking required to provide a medical insurance inorder to qualifyfor residency in the state in which they are self sufficient.

thanks guys but in the eea3 and eea4 forms I can't find any reference to frontier workers, neither in any other documentation on the border agency website.
I'm basically considering taking on a job in Europe whilst maintaining residency in the UK (as my non-EEA wife works here). It might also not be possible for me to fly back to the UK on a weekly basis for financial reasons. I've read that you need to be resident in the UK for at least 6 months a year. If I worked in Europe and came to the UK for say 1 or 2 weekends a month I wouldn't meet this requirement. She has to apply for the EEA4 next year and it looks to me that if I took on a job in Europe now she would not be able to get a successful response to her EEA4 application
