Type of Visa for giving birth in UK

Post by Jamz » Fri Jun 25, 2010 9:31 pm

Greetings All,

My husband is British, and i'm pregnant :)

We want to go to the UK simply to give birth. Is that unlawful ? (we'll be going private - not NHS)

Can i go on a regular visit visa ? settlement is too complicated and takes ages to process.

Thanks

Jamz

Assuming you get into the UK, I don't think there will be a problem. However the problem will be getting past immigration at the Port of Entry. After all your husband is British, and where is the proof that you will actually leave the UK before the end of end of the time allowed?

Or put it another way, what is your "return to return"?

Given that you have mentioned a "settlement" visa, what is your medium-term intention? To settle in the UK?

Thank you John.

This is precisely why we want to apply showing our actual intent.

We just want to know what is the legal way of applying for a visa - simply to give birth and return.

I have read about thousands of people entering and abusing the system by concealing their actual purpouse of visit - i don't want to do it that way.

Although my husband is British, he is well settled in our country of residence, and we can definitley convince the Visa Officer of our return.

Intention is as above - in and out. I mentioned settlement because that seems to me to be the only logical visa to go to give birth, but since we don't want to "settle", it may complicate future applications.

I think your attitude to this is totally correct, to make a full disclosure when applying for the visa. As long as you provide good evidence of "reason to return" you might be successful.

Let's hope you succeed ... then your child will be British otherwise than by descent, rather than British by descent.

Thanks John.
Just want your advice on which type of visa to apply for. Would the BHC ask me to apply for a Medical Visa if i "make a full disclosure", or is a regular visit visa enough ?
