Criteria for I-130

Post by Samreed » Tue Jun 29, 2010 4:09 pm

Does anybody know the criteria my I-130 application will be measured against? My mother is a US citizen as our four half-siblings of mine and so despite being engaged to another US citizen, I thought the I-130 path is probably the easiest.

I've gone through the form, it really doesn't go into much detail other than who I am and whether I've been rejected or not before; does anybody know what I'll be measured against? Any help or advice much appreciated.

What do you mean by "measured against"? What application are you talking about?

Well I've gone through the form and it's so basic - it's literally name and address etc. so I was wondering how the immigration officials will measure up which applications are granted and which aren't. Any ideas?

Aah, sorry, it's the I-130 form: US Citizen applying for citizenship for immediate relation. It would be my mother that makes the application as she's a US Citizen. But she's also not lived in the States since about 1966... I wonder if that will go against me?

Yes, your mother must be either living in the US or be planning to move back there. Depending on how old you are it can take several years. Same for siblings. So it would be much better for your spouse to file the I-130.
