Earning on another job while on tier 2 applying for tier1

Hi All,

My friend is in dilemma he is applying fir tier1.

He was working for a company under Tier2 (intra company transfer) and He get sponsership from other company under Tier2(Gernal) on 1st April 2010 after that he started working for the new company. but visa has been applied on 18th of April and visa confirmed on 13th May 2010.

Can he show his income earned in between 1st April to 13th May?

In my opinion it was illegal for him to work for another company before he had his visa approved for 2nd company.
Showing that should be an instant refusal in my opinion
