Tier 1 Visa - Limits / When to Apply

Tier 1 Visa - Limits / When to Apply

Hi there,

I'm new to the board but if you can help me with this question, that'd be great. I found out that limits on the Tier 1 Migrant visa would be coming July 19. I would be applying from Los Angeles.

Originally, my plan was to apply for a visa in December/January for a move April 1st. But now, it seems like it may be harder to do that if limits are imposed.

Should I apply before the July 19th deadline which I believe means the visa can be valid 3 months later (October)? If I still move April 1st, I 'd be giving up 6 months of validity. Can I apply now and get it post dated for March of next year? Or should I take my chances and apply in December for an April 1st move.

You can get a post dated visa for a maximum of 3 months. You cannot apply now and want a visa in March next yr.

Yes..agreed. But what are the pros and cons of getting it valid as of October but not moving over until April? Is that even possible?

As it stands now, after spending 5 years (2+3) on tier 1 in the UK you'll be eligible for Indefinite leave to remain in the UK (which will be replaced by earned citizenship from July 2011).
If you come to UK 30 days after the validity of your visa then you'll miss on 5 years and will have to go for another extension at the end of 1st extension.
