Query about claiming child tax credits

Hi guys

Im a british citizen by birth

My wife is on 2 yrs spousal visa with no recourse to public fund and from India initially.

We have had our first child and I wish to claim tax credits

Just some questions - which Im unsure about as im reading the claim form..

I know the claim HAS to be joint, between me and my partner, so considering she has no recourse to public funds, am I correct to believe that since im a british citizen, its Ok for me to claim in joint names and wont affect her ILR next year?

Child benefit - I claim this in MY name by the way

The beneath question, I really need help with.. as Im very unsure..

If I can claim, in the form it says the child tax credit will be paid to the main carer of the child, which is obviously my wife as I work full time, and she doesnt work / looks after our home and child, can I now NOT claim this as she is the main child carer ? I dont want to say Im the main carer because I am not., she is.

I have read it and understand that I can place a joint claim as im a british citizen so the no public recourse rules dont apply to her,

I may be answering my own question here but please can you clarify that entering her details as the main carer of child is not going to be an issue, as child tax credit can only be paid to the main carer.

Sorry, no, I meant this one ..... click here. One of the pinned topics must have been posted into, and changed their order.

For a couple living together the claim must be in joint names, but who the money is actually paid to is not an issue. Para 6B of the Immigration Rules is in play here.
