I am swicthing my work permit visa to tier 1 and have a question regarding immigration history section.
Past history:
In 1998 I have applied for asylum in the airport upon arrival with a visit visa, I was given IS96 temperory admission to the UK pending asylum claim. Back then the system was a mess and I didnt get a response until late 2006. I have appealed the refusal in January 2007 which was rejected and in April 2007 administerative appeal was also refused. I have left the UK within 7days of the last appeal volunteraly using my own expenses. And successfully returned to the UK 4 weeks letter after obtaining a work permit visa - I have given full details of my immigration history to the caseworker at the embassy. Since then I was in the UK under work permit visa, I dont get much hassle whenever I go on holiday but on return they tend to get some alert on the system and the IO always goes to the back office to make further checks before allowing me in the country.
Application question:
Has the applicant ever used deception to gain leave to enter or leave to remain? I guess here I would say NO, there was no accusation of deception on my asylum file, but I am concerned whether arriving in the UK with visit visa then applying for asylum is classed as deception. Prior to 2000 I believe visit visa is not regarded as leave to enter? or am I wrong here.
Has the applicant ever entered the UK illegally?
No again? is my time in the UK as asylum seeker classed as illegal entery?
Has the applicant ever been deported or removed from the UK?
No I guess..... upon asylum refusal I left the UK volunteraly using own expenses.
Could someone clarify this, I will clearly include my asylum history Home office reference, the last thing I want is to give the Case worker any reason to think I am with holding facts.
