8yrs study+2yrs spouse of student, = ILR ????? help

Post by max131 » Sun Mar 19, 2006 6:48 pm

i have been 8yrs on a student visa then 2yrs as a dependant of an overseas student, am i eligible to apply for Indefinite Leave to remain based on 10 yrs (long residence), my status now is of a dependant, so will they accept my application at all? PLEASE HELP,

Are the requirements for applying under this case likely to change in the next two years?

my friend is in similar situation, 1.5 yrs left to get to 10yrs, will the home office be prejudiced and are they likely to get funny when extending the visa to my wife, coz they will see that i am nearing 10 yrs

thank you very much.

It appears that you would qualify under the 10 years category if all your time in the UK during these 10 years has been lawful and you have extended your visas in the UK i.e. successive student visas and switch to spouse dependant were all done in the UK.

You are eligible to apply at a PEO or by post.

I'm pretty sure that you don't have to have all extensions done here. If you got any of the extensions done in some other country all you have to prove is that you had a legitimate expectation you were going to come back here so I wouldn't worry too much about having all the extensions done here
