Hello All, My situation is very simple and hope to get all your opinion..

I am on Tier 1 and my spouse is on Tier 1 dependent living with me in UK since Jun, 2006. I should be able to apply for ILR on May, 2011 after living here for 5 years. I am planning to send my spouse back to India now for 7 months and have her return back on Feb 2011. Would this be a problem for her ILR application (via SET(O) form) when we apply for ILR together in May, 2011 since she would be out of the UK for more than 180 days overall, and more than 90 days in the last 1 year before the ILR application. Does these resident conditions apply for Tier 1 dependent as well ? Please help.

Absences from UK do not apply to dependents.

Hi Sush, I thought only the Tier 1 main applicant needs to follow the resident requirements for ILR (i.e. not to stay for more tha 180 days out of UK in five years and not more than 90 days at a stretch.). Are you sure that these are required for Tier 1 dependent as well when applying for ILR ? I thought the only requirement for Tier 1 dependent is to stay in UK for 2 years? Please clarify. Thanks for your help.
