What would be my status after my wife completed ELR?

My wife and I have been in the UK for over 5 years, after entering as singles.

I was just a student.
My wife was granted ELR after refusing asylum in 2001.

We got married in 2002.
When I applied for visa extension on the ground of marriage. HO refused and sent me to immigration tribunal where I won. Judge's decison letter strongly support us we should be together.

After that step, the HO stamped my passport "limited residence permit"(eligible to work, but not for public fund) with the expiray date wich is the same as my wife's ELR.

Now my wife has 4 year completed ELR and to apply for ILR.
My questions are
1. Can we apply together? If so, which forms?
2. What would be my status when my wife's status is ILR? Do you think I would be entitled for ILR as I have been here for more than 5 years and they have already approved that I am spouse of the one who was granted ELR

I think the correct form to use is the SET(O). Your wife should be the applicant on that, and should include you as a dependent on that form.

If your wife is granted ILR then you should get the same.

Do apply this month before the rules change on 3rd April ... when the 4-year requirement becomes a 5-year requirement.
