Can I apply Tier 1 in India

Can I apply Tier 1 in India

Hi,
I am working in UK last 2 years on WP now I want to switch to Tier1 but due to rule change I am not able to apply from UK as they have increased the point.

Can I apply Tier 1 from India while I am in UK? I get my salary in India and here in UK I get allowences. Due to the multiplication factor (5.3) I will be able to qualify with my Indian salary.

Please let me know.

What do you mean? Send application to VFS in India for processing while sitting in UK? or travel to India to submit and return when visa is granted? Whatever the intention, only the latter option is a possibility!

aah! I need to go back to India and apply through VFS. Also I can't come back on my existing Tier2 visa as I need to submit my passport. Am I correct?

Indeed, if you want to apply from outside the UK (India in this case).

And rules are the same whether you apply from UK or from outside UK. You are mistaken if you think / believe otherwise.

I know rules are same but if I apply from india due to multiplication factor I will get point and that will allow me to qualify.

as per the guidance, the multiplication factor for your earnings is as per the country you were living in during the period of earnings ie UK in your case.

You have read the rules but do not understand them (as yet).

As mentioned above, you cannot use multiplication factor to your income credited in India while you were living in working in the UK. This is irrespective of whether you apply from India or from UK or someplace else.

ah i c. It's a funny rule. I was supposed to get the same Indian salary even if I was not deputed to UK. :-)
