EEA4 Application in process, Lagacy Case wakes up.

Good morning

Time line

Arrived to UK on visit visa- Summer 1999
Applied asylum - Autumn 1999
Asylum appeal refused - Autumn 2004
Married my EEA Fiancée - Late 2004
Got 1 year visa as EEA dependent family member
Got 5 year visa (resident card) as EEA family member exercising treaty right - late 2005 (valid until late 2010)
Baby born late 2008 (my wife gave birth in her home country, in EU)
Completed 5 years of our marriage - late 2009
Applied EEA4 - March 2010 (received confirmation of application, waiting for a decision on my application)

Last week I got a letter from UKBA, old asylum cases resolution team. They have asked for a few documents, including my passport (which is already with the UKBA European case department), passport of dependants, my photographs and a few other documents.

Pro of EEA4 route, I get PR back dated (late 2009).
Con of EEA4 route, it may take ages. My wife has a few employment gaps, though those gaps are covered by her part time education (though she did not finish those courses) and her long term medical condition (multiple operations).

Please guide me how should I proceed. How one case may effect the other one?

This is only my opinion and others may think differently.

As far as I can see there is no harm responding to the resolution team letter, and indeed pointing out that your passport is already with UKBA, and indeed why it is with UKBA. I would also suggest you say to them, rather tongue-in-cheek, that if they can encourage their colleagues in the European applications unit to finish their deliberations quickly, well that would enable the resolution team to simply close their file!
