Extension for a person who works for a B Rated Employer

Hi All,

If a person working on a Tier 2 visa with a B rated employer what are the chances to get extension after new government introduced a Cap on Tier 2 route.

Same as any other applicant. Why do you believe B rated sponsor employees have a lesser chance of success?

An application is assessed on its merits and not whether a sponsor is rated A or B. As long as CoS is accurate and you meet the requirements, you shouldn't worry.

Existing sponsors who are downgraded to a B-rating should note that their CoS allocation will be set to zero until they demonstrate their commitment to make improvements by signing up to (and paying the fee associated with) a sponsorship action plan. This zero CoS allocation means that the sponsor will continue to remain licensed by UK Border Agency and be able to continue to sponsor any existing migrants they employ who have valid leave. However, they will not be able to assign a CoS to any new migrants or to existing employees who require an extension to their leave.

I believe they would have to take the action plan and pass it to the satisfaction of the UKBA. Only then could they apply for an allocation of 1 (or more) and issue a Tier 2 CoS. Until they do that I don't think they can get an allocation to issue you a new certificate.
