im a british woman with 2 children and am about to marry an iranian can anybody help me with the public funds restrictions we will have i have been told that while he is on a marriage visa i can no longer claim working tax credits or child tax credits as these are claimed together and a public fund but what about child benefit as this will not be claimed by him it is only in my name and he is not the father of my children
i have heard stories of ILR being rejected because they have claimed child benefit

Who on earth told you that? Total rubbish.

Totally OK for the Child Benefit claim to continue in your sole name, and for you and your new husband to be joint claimants for Tax Credits. For Tax Credits purposes it is irrelevant that he is not the biological father of the children.

thank you so much for this i thought we would have to stop all claims which we would have done i do not want to do anything to make geting ILR any harder

Well i was recently denied my spouse visa because my wife claims child tax credit and the ECO had reasonable doubt that i would need additional recourse to public funds.

What i know is a couple of days after we got married in England Jobcenter called my wife and asked her to fill in an application but not a joint application since i am not living there right now, what i understand is that she would have to jointly apply for it when i get there but she would be the recipient.

My question is would the benefits increase when she applies jointly? i tried looking on the HMR site and the elements are the same, it doesnt show any increase, How does child tax credit and additional funds come together what are they thinking of?
