PSW / ILR INFORMATION

Hi,

I am on student visa in the UK Since May 2002, I have completed my MBA recently and expecting my results by end of Sep/ Oct 2010. I have my student visa until Jan 2011 [i.e 8 years 8 months student visa].

I am planning to apply for PSW in Nov 2010, so I would like to know whether my 8yrs 6 months + 2 yrs PSW will count towards long stay and I can apply for ILR.

I have read all your posts some say yes some say no, so I am bit confused i would really appreciate some feed back on that.Look forward to hear from you guys.

Time spent in UK under PSW can be used to apply for settlement under the long residence category.

Settlement
This section explains how the time you spend in the post-study worker category does not count towards the period you need to spend in the United Kingdom before being eligible to live permanently in the United Kingdom (known as 'settlement' or 'indefinite leave to remain').
Your leave in the post-study worker category does not allow you to apply to live permanently in the United Kingdom.

Wrong advice.

One cannot use time spent in UK on PSW leave to apply for settlement as an economic migrant but can do so to apply for settlement under long residence category (as mentioned above).

Dear Sudesh Mehta,

Thank you for your reply The doubt i have is as Askhan said it does state on the UKBA website. why does it say it dose not count towards settlement. can you please explain.

You are reading a published information for economic migrants and settlement under economic migrant category. Time spent in UK as Tier 1 (PSW) migrant is not counted for settlement under the economic category. Hence the information is accurate, no doubt!

But, settlement under long residence catedory have different qualifying criteria. For example, settlement under 10yr. long residence category is based on 10 years of "legal" stay in the UK .... and time spent in the UK under Tier 1 (PSW) is definitely legal - therefore can be used to apply for settlement under the 10yr long residence category.

Sushdmehta is correct. However just be aware that it is widely expected that Long Residence category be discontinued in the immigration reform that is implemented from July 2011 onwards, although nothing is set in stone yet. Make sure you keep up with the developments
