PSW rejected but didn't get the result in time

Post by fishwry » Tue Jul 20, 2010 1:13 pm

I applied for a psw visa before my last visa expired. Then I just stayed in the UK and waited for the result. A few days ago I got the result. The envelop was threw into my apartment. For such important documents they didn't even need my signature? Actually they rejected me on March! But I didn't know that until a few days ago. After I knew the result, I left UK as soon as I could. Now I am outside of UK.
So the problem is, will this situation be considered my fault? Say, will they consider me stayed in the UK illegally?
Please help. Thanks.

If you wanted your documents and the decision to be delivered to you in a different manner (requiring signature), you should have made arrangements accordingly e.g. - included a prepaid special delivery envelope along with the application. Can't blame UKBA for that!

Anyhow, if you stayed in the UK for more than 28 days from the date of the decision (refusal) then it may impact future EC applications.

Thanks for the reply.
The signature is not important. The point is they didn't send it to me within a reasonalbe time period. I mean this could be some kind of administration error or royal mail(or somebody else) not doing its job. I think it's unfair for me.

I have no problem with the refusal itself. It's the delay of delivery put me in a hard situation if I want to apply for another visa.

Understand the frustration, but the issue is that you will find it difficult (rather impossible) to prove that you were not at fault.

If the documents were only sent a few days ago, the post office will have records to show the date of delivery which can be used as an evidence.

My personal understanding of your situation is that, you failed to check at the given address and found your documents when you checked a few days back, in which case the fault is yours and you would be regarded as an overstayer.

I lived in that address everyday. I swear to god I just received it a few days ago. And honestly speaking, I thought, before I received it, that the time it took to make the decision was normal! I don't know what else can I do.

Then contact the post office for the date of delivery.

Unless UKBA posted the package using recorded delivery or special delivery, I have my doubts they would have any records of delivery / date.

Do they keep records for 1st / 2nd class mail?

just for my curiosity, in my case, if i don't say anything, they wouldn't know about this, right? I mean, they don't know when exactly did i leave the uk. this is a loophole in the system.

Don't be naive! You need to send in your passport with any application ... and all one needs to do is flip the pages and look at the landing stamps.

Unless, of course, you want to risk getting banned from entering UK altogether.

:shock:

@Sushdmehta

I honestly feel they maintain records for all the mail delivered although it might not be normally available to the public.

@fishwry

Are you planing to get a new passport or believe that your exit date will dissapear from your passport 1 yr from now?

Well my point is: I will be considered as having overstayed in the UK. Since I left voluntarily, I will be given a one year ban. So after one year it's fine.
