Post by dude_123 » Mon Jul 26, 2010 8:03 pm

On HSMP tier 1 general visa,

I been working in UK but my employer is paying tax on behalf of me and salary slip issued from India without UTR number.
What doc i can provide at the time of extension in that case?

Anybody facing same situation or expert advice on same , then please paste me up!

Thanks,

It is either HSMP or Tier 1.

Are you saying that your employer is deducting (and paying taxes) in India on your income in the UK? Or is it that you are being paid base salary in India (on which employer deducting tax at source) and in UK you are only paid subsistence allowance? Or that you are paid salary in the UK (and pay taxes here) but the payslip is generated and issued from India? Please clarify.

It is Tier 1 general migrant visa. NOT HSMP or NOT INTRACOMPANY.

I am deputated to client place from india, and employer paying me two salary.

1. Basic salary in india (RS) , Salary slip issued from india
2. Basic component only (BASIC=Monthly net) in UK(GBP) , salary slip issued from india.

My employer said me that salary is tagged with NET component and TAX is being paid by us in UK as well, we can not provide UK salary slip with UTR number. In that case, i can not use salary slip as income proof for extension.

What docs i need to submit for extension?

Good to know that you are aware of this fact, as your opening statement itself was contradictory:

Also, Intracompany comes under Tier 2!

Coming back to the issue at hand, it appears that your employer is either not paying taxes in the UK or your remuneration in the UK includes allowances that may be non-taxable. You need to figure out the truth for yourself.

As for earning calculations, assuming that UK allowances are such that can be considered as "salary" (read policy guidance), here's how you may claim earnings:

A: Indian salary (without using uplift factor) converted to GBP (convesrion method explained in policy guidance)
Evidence: payslips + bank statements
+
B: UK allowance in GBP
Evidence: payslips + bank statements
