For how long Tier 1 (General) Dependents can stay out of UK?

Post by faadibutt » Tue Jul 27, 2010 6:29 pm

I am in UK on Tier 1 (General) visa.... Last month my wife applied for visa as dependent of me from Pakistan and got her Tier 1 (General) dependent visa. Now my Questions are:

1). My wife's visa is valid from now on but for some problems, she has to stay back home till december 2010 and can't fly within three months from the date her visa is valid.... I know on some visa categories, there are restrictions that you have to enter UK within three months once your visa is issued but does that rule applies to Tier 1 (Genral ) dependents as well??? Does she also has to enter UK within three months or can she stay back home for few months?

2). Since my parents are back in Pakistan and there is no one except my wife to look after them so she can't stay with me in UK permanently. She can only visit me once a year for few months, I know Tier 1 (General) main applicants can't stay out of UK for a consecutive 90 days periods but does that rule applies to their dependents as well.... Do their dependents also can't stay out of UK for 90 days or there are no restrictions on them entering or leaving UK for longer periods..... When I will go for extension for my Tier 1 (General), will that be a problem that my wife (my dependent) stayed out of UK for more than three months....

Your help will be really appreciated...!!!

Your wife may enter UK at anytime during the validity of her leave to enter (visa). But in such case, she might need to apply for an extension before becoming eligible for settlement.

Absences from UK come into play when one applies for settlement. Point Based System, per se, does not impose any restrictions on absences from the UK either for the main migrant or the dependent.

When applying for settlement as a dependent, the dependent is not subject to the restrictions on absences from the UK, unlike the main migrant.
