discretionaty leave help

hi
I've overstay my student visa by 6months . I've been in the uk since january 2007. I have 1 dependant born here she is 13months and has indefinite leave . i`m a single mum and her career . Now i'm looking into applying for discretionary leave but don`t know where to start . Please help if you can. thank you.

If the father is not interested in the child and/or is not British then you'll have to leave the UK I'm afraid, DL is a non-starter if the above is true.

the father is intersted in his child .he is the one who is supporting us (financially) but we can`t be together and i don`t want to live without my child. anyway thank you for your time

Is he British or has at least ILR? If so and you grant custody of the child to him you may apply for an Access to Child Visa.

he has ILR. where can i apply for an Access to Child Visa here or in my country? if in my country that`s mean i have to go without my child.

You can register your child as British using form MN1 with the help of the father holding ILR, from then you can then apply for DLR in country with the help of a lawyer this should not be a big problem but first Register your child as British this with give more weight to your DLR.

You easiest solution to this is get a shared residence order for child and then you can apply easily for access to child visa(from Oversea).

You can also make an application for DL.

Important thing is a court order to back up your case.

Otherwise Wanderer is right..You have little hope.
