Hi,

I am married to a British citizen and we recently separated though not divorced yet. I was living in the UK under spouse visa which is valid until Sept 2011. But I recently returned to India to switch from spouse visa to Tier 1 visa due to my current circumstances. I applied for Tier 1 on the 14th of July and was refused due to insufficient documents. I will be applying again with more documents but in the worst case scenario that it gets refused again, will I be able to enter in to UK with my current spouse visa which is valid until sept 2011.

May have problems entering the UK as spouse visa is subject to 321 and 281(iii) is not satisfied.
