Validity of Spouse Visa in the event of Tier 1 rejection

Hi,

I applied for Tier 1 on the 14th of July but have not got a decision yet. I am worried it will be rejected as only after applying I found out the documentation I provided is not complete as per the guidance provided by UKBA.

I have a valid spouse visa (valid until sept 2011) and also have the original resident permit card with me. In the event of my Tier 1 application getting rejected will I be able to enter the UK on my existing permit?

The current visa you have - is it a spouse visa or a dependent visa?

Hi, it is a spouse visa. I am married to a British citizen and we recently separated though not divorced yet. I got the decision for the application made on 14th and it was rejected. I will be applying again on Monday but in case it gets rejected again will I be able to return to the uk on my spouse visa. I need to do that to mainly vacate my flat in the UK and bring my things back and quit the job that I already have in there. Thanks for the help!

I do not think that your previous visa will be invalid after Tier 1 rejection. If it will be then you will be given notice in advance. Under your situation, you have not ended relationship legally. It is still relationship and there is no reason that you can not come to the UK. Check UKBA site, there are information.

Since your Tier 1 visa is just rejected, you must not be hurrying to apply again. Make sure that you are not again applying with same situation. Now you will also need to score 100 points. Think carefully and check documentats before applying. Ask questions about specific situation, I am sure that people will share their experience.
