URGENT Help. Refused application, not scored earning points.

My friend is on Student Visa in UK.
He applied for Tier 1 application on 29th June 2010, and case worker didnot awarded points for earning stating following reason:

You claimed earnings for the period for 1 February 2007 to 31 January 2008. However, you have claimed earnings outside the 15 months period prior to date of application. The 15 months period runs from 29 march 2009 to 29 June 2010.

Deferment of earnings can be claimed only on maternity/adoption grounds. As such, you not entitled for deferment claim of earnings.

But when we applied it was mentioned on UKBA site that student can claim earnings for 15 month prior to when they arrived in UK on Student Visa.

I have only3 days to appeal, any help, advice and suggestions will be highly appreciated.

Please let me know if I should appeal or not.

:D Maybe you looked at some bogus UKBA website!

Did you/your friend make an effort to read the policy guidance before applying? The decision is correct so no question of appeal - unless enough points can be scored without the earnings.

Decision is correct. Nothing can be done. The rules to back date earnings for students was changed in Oct/Nov 2009.
