hi .. i am a uk resident and i wish to marry a person who has been in uk since 2007.. he came on spouse visa and has now been divorced through courts.he did not receive his indefinate stay, and is now studying an open university course, he applied for his extension in may 2009 and is awaiting decision...so he is legal until he hears on his answer.. we have a few options so far.. should we wait to see outcome of certificate of approval and how long wil that take? what if they refuse? .. or should we do nikah (islamic marriage) and live together and apply after? .. or should we do nikah and he could go back to pakistan and apply there? im confised, please help anyone.. need some advice thanks

What exactly do you mean when you you are a UK resident? Citizen? Settled person? someone with temporary leave to enter / remain?

His spouse visa is invalid now, he must return home an apply from there.

His app to remain will be denied.

Permanent resident doesn't mean British Citizen, please clarify - which are you?

yes im british i have british passport have been here all my life
