Spouse Visa ILR Due But hubby Working

Hello Everyone,

Am abit stuck, looking for some advise:

Am on 24months Spouse Visa and am due for my ILR on the 18th Sept 2010. I have gathered most of the documents needed.Done my life in UK.

Now my biggest worry is, we got a phone call from his company last night(friday) that my husband MIGHT be travelling on the 6th Sept,2010 for work for about 1.5months. In the SET (M)its states i need his Passport, what will i do without his passport?? I got his birthcertificate but will that help??

Or should i cancel my premium appointment and instead go for FLR? What should i do? Pls someone help

A FLR(M) application will also require your husband's passport.

When did you initially arrive in the UK on your spouse visa?
When will your spouse visa expire?

I arrived in UK on 14th October?2008. Visa Expires 9th Oct, 2010

Have you got any idea what other options i have got?? Without his PP??

As not all British citizens hold British passports, the notes on SET(M) do provide for similar circumstances:

Note 6 If your partner is a British citizen without a passport, you must provide his/her full birth certificate (showing the parents’ names), accompanied by at least one other formal document as evidence of ordinary residence in the UK for the last three years. Anyone born in the UK on or after 1 January 1983 will only be a British citizen by birth if a parent is a British citizen or settled in the UK at the time of birth. In that case, we will need evidence of the nationality or immigration status of your partner’s parents at the time of birth for us to be satisfied that he or she is a British citizen.

If you can supply a complete certified copy of his passport AND his original birth certificate AND some kind of formal residence confirmation, I can't see any reason why your application should be refused.

Thanks for your reply. What type of formal confirmation document could i present?? Bank statement, fishing licence, etc? Letter from his company, pls advise

As a rough guess, I would think that things like bank statements from the past 3 years (not necessarily the whole lot: one per quarter maybe?), council tax bills, utility bills etc. would fit the bill. If you're submitting a certified copy passport, copy every page: this should also show your husband has not left the country (other than for holidays) during that 3-year period.

Don't forget the letter from your husband's employer confirming he's on a limited posting.

I can't believe that UKBA have never encountered or contemplated this situation before (but then I am by nature of a sunny and optimistic disposition ), so try giving their enquiry line a call (make sure you have a bit of time to sit in the queue of course).

Thanks for getting back and all your advises.

Actually am also wondering if all people have always had there spouses PP. I surely think there should be someone somewhere in similar case as myself. Oh well am gathering everything that i can lay my hands on. Will even take copies of his flight tickets etc. Might have the American company to write a letter for us as well explaining about his travel etc. Will do my best and hope for the best. Also will ring the UKBA Adviser and find out.

Meanwhile will tighten my belt and get everything that i can sorted.
