Travel to India -Current Work Permit will be null and void

I was recently made redundant and am due to hand in my papers on the 30th of March. I am taking advantage of the 28day benefit period to search for another job in the meantime. However, due to unavoidable circumstances my wife, who's studying in the UK but is on a dependent visa, will have to travel to india on the 1st of April and return on the 7th of April. My concern is whether the immigration authorities would prevent her from entering UK because of my situation which is scary, given that she has to sit for her exams shortly afterwards.

Please advice.

My wife was in a similar situation (between jobs, left old job and new work permit did not come through before she had to leave due to a family emergency in Canada)- she was advised to reenter as a visitor rather than enter on the old work permit as she would be in breach of immigration rules if she entered on her old work permit which became invalid the moment she left her old job.
The fact that she came in as a visitor reset her clock for ILR also- she lost 2 years she spent on her first job and had to apply as my dependent, even though she came to the UK six months before me.

The law says, after one's WP expires (or s/he leaves job), the HO will issue a letter to him/her saying his/her current LTR is no longer valid. After receiving the letter, within 28 days one must leave UK or convert to some other valid/legal visa.

Once I re-entered UK during my last week of WP. The officer at port asked me "Do they (employer) still require you?". I replied "Yes, they have already applied for my extension." Then he said, "Ok, as long as you have a valid visa, I have no problem."

i know this guy who was between jobs, and used to enter and exit the UK at will, until he finally got a job 8 months later, 4 years on, he applied for ILR


another story is of this guy who was looking for a job since he had been laid of, he was returning form his nth trip to europe, and the visa officer asked him, are you working in the UK(any change in your conditions), and htis time he replied "i have been laid of", his passport was impounded, the immigration officer said that if he had kept his mouth shut, he would have managed to get in. honesty is not obviously the best policy. the immigratiion people at the port of netry dont obviously have the "who is still working" database

At the time of ILR, you are supposed to give details of your stay out of UK and if the Home Office decide to match your employment records with your stays out of the UK, you could be in trouble.
Well, you might not be caught- but you are in breach of immigration rules if you leave the country and re-enter on an expired WP.. I won't personally take that risk.
