Hello everyone,

First of all would like to say thank you very much for having a discussion board like this that offers some sort of advice for those in need.My situation is quiet tricky please be patient with me because i am highly distressed and just need some real advice.
I am a malaysian married to a Britist citizen.We got married in Pakistan in the year 2007.At that time my husband was separated from his first wife in the uk but didnt legally divorce her.So at that time of marriage with me he was still legally divorced with his first wife.Please also to note here due to some financial problem and unemployement my husband couldnt sponsor me for settlement visa so i requested to visit him.I was refused entry to the uk first time before we got married because they reason was i havent met my husband before.So we had to get married in pakistan.THen i requested to visit him with a tourist visa and mention that i wanted to visit my husband.I was refused visa because they said i didnt have suffiencent proove to say that i will return back to my country after the visit because i didnt have anyone in Malaysia to return too.Anways not to mention being away from my husband for all this time we tried our chance again on more time this time traveling togehter and this time thanks god i been given entry to the uk for 6 months.In this perioud of time my husband was trying his best to sort out the requierment for our papers for me to go back to apply for settelment visa.Because he was unemployed it was very hard for us to even pay for the divorce settlements and requested from the home office to extant my stay.They gave me another three months stay but even then to our despair we werent able to gather up the requiered documents.I exited the country to return back to the uk to seek for extension of stay this time they refused me and sent me back to Malaysia.Its been almost a year now since i saw my husband.I been crying everyday mostly because we cant afford for any sort of legal advice.We admit it was a big mistake with no proper planning in the first place.Since then my husband has managed to obtain a decree absulote thanks god but my question is please bear with me as i have a few..

1- Can i apply as for a spouse visa bearing in mind that our marriage is certainly not legal because he did not divorce his first wife while marrying me.But now that he has done so does that entittled me for a spouse visa because termination of the previous marriage.

2- If i cant apply for a spouse visa,may i apply for a fiance visa to get married in the uk again because our previous marriage is not recognised.I cannot get married in my country because we have already reqistered our marriage here.If i have requested to visit my husband in previous application wont it be a suprise for the uk immgration as to why i am applying for a fiance visa now?

3-My husband since then has managed to get a job and is working hard to meet the requierments for the spouse visa as in we have proove our relationships.photos,ongoing contact,travel stamps.Adequate accomadation etc.What are my chances and what is the best type of visa to apply for.

Please advice me as i wish all this can end asap so we can lead a normal life and not worry of being away from my husband for such a long time

dont apply for a spouse visa, all the documentation you will require to demonstrate your relationship will show that he was divorced AFTER you married and could invalidate your application. You could go down the fiancee route and marry in country

thanks very much for the clarification.But just still a little confiused because uk home office didnt know about his previous status i dont know why! And we ourselve over looked the fact because talk about being ignorant! Anways after much research i knew that my husband had to obtain a decree absulote and my marriage was not valid.But my question is how do i get married again because i cant get marry in my country because we already registered.Another point to note here is that my previous visa application they know i am his wife and even granted entry in two occassions for visit as wife.So how i change this and apply for fiance visa.Wouldnt that be confiusing! I am confiused too! :shock:

apply for leave to enter as a prospective spouse and just be honest. Tell them you married but were unaware of the status, that you cant remarry there and that you want to legalise your marriage here. They may not know about his previous status but with submitting marriage certificates and through interviews it may pop up. I find its more credible if you are honest and tell it as it is, if they know you arent hiding details it will add in your favour.

yes i honestly thought i will just tell them the truth.ITs better for them to find out and think i have been hiding information from them.Thanks very much i hope this works! God bless!
