Student Visa Cancelled on Maternity leave?

Post by vajira_uk » Sun Aug 22, 2010 11:48 am

My wife was given UK student visa in 2008 valid till 2011. She went on Maternity leave last year(2009) and currently stays outside UK.

At the moment, her "University Student Status" is suspended and it has already been informed to the Boarder Agency by the University. She was also told by the visa advisory officer of the University that her student visa may be cancelled by the UK Border Agency as University has informed about the suspension of the student status.

Does she need to re-apply for UK VISA? Is there a way to find out her current visa status from UK Boarder Agency?
Please advise...

Thank you

Are students entitled to maternity leave?

The college has suspended her for lack of attendance rather than for any other reason. Did your wife with the University / college if a long leave of absence was acceptable to the University / college and that she could defer her studies to the next semester / year?

IMHO, re-apply, with a CAS.

sushdmehta, thank you for your reply

My wife was given an extension by the university as she is a post-graduate student. The university has officially granted maternity leave, and extended her study period, but they has suspended her student status and informed UK Border Agency about this.

So, she wanted to find out about her VISA status, and whether she need to re-apply VISA

thank you,

Sounds contradictory!

If you need personal information about your wife's immigration history / status, I guess the most appropriate way (and perhaps the only way) is through Subject Access Request.
