EEU family permit

Post by callyj00 » Mon Aug 23, 2010 11:35 pm

I am hoping you can give me some information/advice about my situation.

I am a South African Citizen that was working in the UK for 4 years on a visa sponsored by my company. A year ago I was sent to the US by the same company on a secondment. In this year I have married an EU national (Italian). I will be returning to the UK in the next month but I would like to go back on an EEU family permit as it gives me the freedom to move between companies where as my current Visa only allows me to work for the same company.

So my questions are:

1. Can I apply for the EEU Family permit in the US before I return to the uk or is it better to apply once I return to the UK? (I think processing times are shorter in the US)

2. My wife wont be returning to work immediately as she is expecting (I think this means she is not a “qualifiedâ€

What is an EEA family permit and note on residence card (last paragraph). How to apply for a residence card and the European Casework Instructions. If your wife is on maternity leave she is still a qualified person, if not look into the self-sufficient route and make sure to have comprehensive sickness insurance. Actual experiences of timelines.
