Tier 2- request for initial or additional allocation of COS

Post by pokale2600 » Tue Aug 03, 2010 11:06 am

Hello everyone,

can anyone please help me out with a supplementary form Tier 2 ( general) request for initial or additional allocation of certificate of sponsorship)??

Currently i am on the post-study worker category of Tier 1 visa, i have been working with a pharmaceutical company on same job for past 1 year. now i wish to switch in to Tier 2 general category as my current leave is going to expire on 20th of sep 2010. according to new rule all sponsors who wish to request for Certificate of sponsorship after 19th april 2010 will have to complete a supplementary form (Tier 2 (General)- request for initial or additional allocation of certificate of sponsorship).

My company had applied for sponsor license 6 weeks back and application is still pending. so i believe when company get sponsor license, we will have to fill and submit a supplementary form for COS.

In the supplementary form section one (page No. 3) ask for details of migrant employee whose leave sponsor wish to extend. In my case i dont have COS/ work permit number neither shortage occupation code. since i am switching from PSW to tier 1 general i dont need to pass labour test neither my job will have to be on job shortage list. My question is how can i/ sponsor complete the table in section 1 of a supplementary from (Current CoS or work permit No. and S/Occ columns)?? or do I/ Sponsor have to leave those columns empty??

It will be very helpful to know how to fill and submit a supplementary form in my case. all sort of reply's are appreciated.

Thanks,
Amit[/b]

I can def understand how stressful it is being in such a miserable situation. what i understand is when our company get sponsors license. we will be allocated 0 CoS or if sponsors license is likely to be successful UKBA will ask company to complete and submit tier 2 supplementary form. in both scenario we will have to submit tier 2 supplementary form before 25th of this month. UKBA panel is going to assess all supplementary forms (all forms submitted before 25th) under case of exceptional consideration on 1st of next month. they will come back to sponsor within 5 days to inform if they can allocate CoS that sponsor has requested for. so this means if our company's sponsor application remains pending by the end of this month we better book our flight ticket, unless we get some help from experienced member/ solicitor.

does your company have solicitor??

Hi All,

I am in the same situation as you guys.

But I have already been refused once because my job was not according to the code of practice.

I first applied before 19th of July before the new limit came into place but was rejected.

I am now submitting fresh application and my company has been given zero CoS allocation. My company got the licence early July and issued only once COS and since my application was refused, y company is having to request a new COS for me. But it seems that with the new cap, i'll have to go through all the waiting just like you guys.

I have a question regarding the form too, there is a section where the sponsor need to enter some number. In my case my thought is since we were granted licence early July and has not sponsored anyone yet, will my company be considered a prospective one or existing one?

- A2. For prospective sponsors - please enter the application number from your on-line application: (SPL)

- A3. For existing sponsors - please enter your Sponsor Licence Number:

Reason I'm asking this question is, HO has a migration committee which will decide on COS additional application based on a priority according to the following:

* 1. A Work Permit or Tier 2 (General) extension for an existing sponsor;
* 2. A Work Permit or Tier 2 (General) extension for a new sponsor;
* 3. A new shortage occupation post for an existing sponsor;
* 4. A new shortage occupation post for a new sponsor;
* 5. A non-shortage occupation post for an existing sponsor;
* 6. A non-shortage occupation post for a new sponsor.

sorry for being too long, but can someone please advise.

Thanks,
Ashley

'Urgent consideration' email from UKBA

Post by Nukite » Mon Aug 23, 2010 6:46 pm

Hey guys,

I'm also in this sorry situation.

We've had an email saying if we wish to apply for 'urgent consideration' that we can scan and send the same form to a certain email inbox.

I phoned UKBA to ask about this and they couldn't tell me anything, e.g. whether it is worth applying for 'urgent consideration'.

Can anyone confirm that we have to advertise the position before submitting the COS(AR) form?

And is this still the case if we wish to submit by email for 'urgent consideration'?

Thanks!

Julia

Wait for sponsor licence before submitting CoS(AR) form?

Post by Nukite » Mon Aug 23, 2010 6:49 pm

Hi guys,

I'm still unclear as to whether we should wait for the sponsor licence to come through, and then advertise the position, and then submit the CoS(AR) form - or whether we should submit it now, otherwise we will not get a licence, and THEN do the advertising!?

Nukite, no. While your company is waiting for Sponsor's License to be issued they can advertise your position (of course, they have to do so only if you haven't been employed by that company for 6 months and/or they haven't paid you the salary, which you show as your prospective earnings). So, there's a way to win a little bit of time. :wink:
