leaving country during 2 year spouse visa and IDL

Post by skooby » Mon Aug 30, 2010 10:45 am

Hi there, I am a UK national and was born in England. I lived in Japan for three years where I met my wife who is a Japanese national. We got married in Japan and she came to the UK on a 2-year spouse visa. It’s been one year so far. She has sat her life in the UK test and passed and is looking at sitting her ESOL Level 2 test soon + working towards her IELTS English exams. It is our intention for her to apply for indefinite leave to remain.

I have a few questions. If we both go traveling, can this in any way invalidate her 2 year spouse visa as we want to go on holiday but are not sure for how long and how many times she can leave the country. We have already been to Morocco for about 7 days in February.

Also I am a teacher and would like to teach abroad again in the future for the British council. If we go before her two-year spouse visa is finished, does this mean she cannot apply for indefinite leave to remain? If we still decide to live abroad so I can teach, does this mean we would have to re-apply for a spouse visa when we come back to live in the UK as this would obviously be a step backwards.

If we decide to wait for the final year so she can apply for indefinite leave to remain in the UK and then we go abroad after that, can her indefinite leave to remain be invalidated if she lives abroad with me? Does it mean we have to apply again for a 2-year spouse visa upon our return or indefinite leave again?

We want children together in the future and they may be born abroad if I am working abroad. Will my children still have UK citizenship considering I was born here and am a UK national as it’s very important to us that they have this, as we will live here in the future.

\i know I have a bag of questions but any assistance would be greatly appreciated! :D
