Tier2 - Sponsorship Licence Late Application

Dear All


Basically, I am on 36 months Work Permit Visa, which expires on the 1st of November. The work permit expires at the same day because it starts when visa started.

I am staying with the same employer, same position, so I qualify under Transitional Arrangements.

However, we didn't realise that the application for Sponsor's Licence might take a few months. We started the ball rolling as soon as we knew this, but I am quite worried because the time is running out and I do not qualify for Tier1. So I have to stick with Tier 2.

The online application for Sponsorship Licence was submited online on 27th of August. At the same day we sent on post the required documents and COS (AR) along with photocopies of my visa and passport.

This gives them 9 weeks to process the Sponsor's Licence application and the COS (AR) thing. However, I know that there is only one monthly panel meeting where they process the CoS. I guess we missed the September's panel and the November's panel would be too late for me.

In your experience, what are the chances that the application for Sonsor's Licence and the COS (AR) are processed at October's panel meeting?

Do they process the COS (AR) at the October's panel meeting even though they might have not processed the Sponsor's Licence application?

Is there anything that my employer or I can do to speed up the process?

What is the best form to contact them ? Email, Writing, Call?

It sounds stupid but, is there any possibilities that I can buy some time, i.e. the work permit expires at the same day the visa expires and I can't travel at the same day?

Are you saying that your employer is not on the sponsor register yet? And the employer has submitted both an application for sponsorship license and a application for additional CoS?

That's right. My employer is not on the sponsor register. They applied on 27th of August.

Then, logically, the CoS application will not be entertained unless the application for sponsorship license is approved and employer included in the sponsor register. Do take into consideration the timeline involved in being granted a sponsorship license as this may require checks / verifications by UKBA staff.

Also, assuming the license application is approved, whether your employer is given A rating or B rating may also influence the CoS allocation timelines involved. If given a B rating, the request for CoS will be considered only of your employer signs up to the sponsorship action plan and pay associated fees.

Well, assuming that the license is approved and my employer is given A rating, do you think that there is enough time for everything?

I know that only UKBA can tell these things, but probably someone else had a similar experience.

An update,

I do not know how bad is this, but they just asked us to resend the documents again. They said that all copies should be signed from the owner of the company. Authorisation officer is working on this and hopefully we will resend what they asked for by today or tomorrow. I am quite sad and tired. I can't even be bothered to see in the guidance if it is required for the copies to be signed.

My case is similar to yours, My employer applied for tier 2 general status in the month of July and it was delayed for no reason. My cos application was submitted in sept for oct panel meeting. panel rejected my cos on 4th oct and approved my employer license on 6, lol funny as sweet. they should have looked at the license application before the panel meeting & should have said yes or no to the cos request. My psw expires on 7 Nov and I got no time to sort out my probelms. At the moment I am waiting for 1st Nov panel decision. I have no clue wats gonna happen in the Nov panel meeting.

I would like to know what happened in u r case, much appreciated if u could let me know.

supporting company documents are supposed to be originals or certified by a lawyer. The company owner signing them probably won't do any good. They could be refsued again.

Tier 2 (General) - request for an initial or additional allocation of certificates of sponsorship wrote:Applications submitted by prospective sponsors will be held until a decision is made on the sponsor licence application. The application receipt date is the date an A-rated licence, which includes Tier 2 General, is granted. If the application for initial CoS is valid and the decision on the sponsor licence is made on or before the 24th of the month, the application for initial CoS will be considered by the panel convened at the beginning of the following month.

If the sponsor licence application is rejected or refused or granted with a B rating, the application for initial CoS will be rejected.
Since you are extending from WP to Tier 2 (General) your CoS application should be on high priority clearance, depending on the outcome of the sponsor licence application.
