SPOUSE VISA - Hoilday

Hi

Me (british) and my hubby ( Caricom passport with UK Spouse visa) are going to the carribean (St Maarten) for xmas and new year...we are travelling out together via New York (8 hrs wait) and he is staying back for extra 4 weeks. When he returns he will fly to UK via Antiga (another carribean island)

My question:

1. Does he need a Transit visa for USA, and if so which one in particular
2. His Spouse visa ends at the end of Feb and his return flight to the Uk is the beggining of FEB. He will be applying for Indefinate leave when his spose visa expires. Will he have a problem coming back to UK?

1. Probably, C1 Transit Visa. Have a look through this:- http://travel.state.gov/visa/temp/types/types_4383.html
Best also to check with the airline.

2. No, as long as you are contactable if necessary to confirm that you are still married and living together.
