Hi guys,

I must commend everyone for sharing their experiences on immigration related issues.

I am currently on Tier 2 (originally a work permit holder) and should qualify for ILR in november 2012 (assuming the July 2011- probational thing did not kick in).

However, I have a question to ask.....

First WP was issued in October 2007, leave to remain stamped in Nov.2007 for 18 months.( expired May 2009)


Applied for extension in April 2009 under Tier 2 transitional arrangement.......was refused with rights to apeal........

Appealed in time through a solicitor in June 2009 (3 days after receving refusal letter from HO) and won appeal (Appeal heard in July 2009 and decision made in Augsut 2009).......(according to solicitor,,,,,my status at the time of appeal remained the same as a WP holder and I was legally entitled to work untill my appeal right was exhausted)

Tier 2 visa stamped in Dec. 2009 .....till May 2012.....

Will extend with no problems hopefully although i'm challenging the 3yrs given to me instead of 3yrs and 6months.


So here is my question......assuming I extend my Tier 2 successfuly in May 2012 to Nov 2012, will my stay be considered as having no gap (2009 refusal and appeal period referred to)....



Please advice

No gap, thanks to Section 3C protection.
