Irish girl with non-EU guy

Hi I'm an Irish citizen who is expecting a baby with a non-EU national, my boyfriend is on a student visa, can he stay in Ireland once the baby is born and if yes what rights does he have with regards to studying, working etc? Thanks

Having an Irish citizen child confers no right of residence in Ireland.

There is no right for your partner re Irish Born Child anymore, are you married, if you are married then he can applied under other type of residency. I am not so conversant with the rules but I believe a lot of people on this forum should be able to advice you on what to do.

If you guys are not married than you have to show 2 years relationship sequence. Your case will be filed and the long and slow process will begin. Sorry to say this but there is no right under immigration law nowadays on the basis of Irish born child, even a cohabiting relationship doesn't count under Irish immigration law (only marriage). Its only decided at the discretion of minister which means your case will be filed and you need to show like dual bank statements/bills/mortgage/rent book etc etc in both of your names (if you have previous two years record of the above then you might and i stress might be in luck).

pants, do you hold any other other EU citizenship?

If not, the defacto route is the only way for you unless you get married.

As previously said, you need to show 2 years proof of living together ie: joint bank account statements, PRTB registration, rent book, lease, bills.. all in both names. Photos and letter from friends and family can help too.

Note: Applications are at the discretion of the Minister for Justice and can take up to 12 months. Also if your partner has any negative immigration history (like overstaying a visa etc) this will definitely count against the application.
