Can I stop my kids being taken out of country?

Can I stop my kids being taken out of country?

Hi,

I have a question re my kids and would appreciate any help here. I am happily married for 6 years and have three beautiful kids. However my parents in law (living in India) have been interfearing in our lives a lot and complaining about silly things. My father in law has threatened me (even by coming to my house in UK) a few times that he will take my wife and kids back to India. My kids are born UK citizens whilst I got UK citizenship about 7 years ago. My wife isn't a UK citizen as yet and is on ILR. She is under influence of her parents as they have been calling her all the time when I am at work and giving her stupid advice etc.

My questions are:

a) As UK citizen, how I can stop my father-in-law to stop threatening me?

b) the most important question is that how can I stop him from taking my kids out of UK without my permission? Can I ask for a court order in advance to protect my kids. I have heard of Prohibited Steps Order but not sure about the process. Can someone please guide me and point to some links? Should I do it through a solicitor or doing it on my own would be fine?

I would appreciate any help/guidance here and please do ask if more information is required...

Given that you "not sure about the process" you certainly need to consult a Family Law solicitor.

If you are not in a strong enough financial position you could hire a solicitor, if not, you might want to apply under Section 8 of the Children's law Act 1989 for a Prohibition Steps order on Form C100, please bear in mind that India is not part of the Hague convention, so it is vital you get these orders in place ASAP, so as to prevent the children taken out of the UK jurisdiction without your consent.

Thanks very much guys. I'll surely consult a solicitor. Does anyone on this forum know of a good family law solicitor (or know a solicitor on this forum) who could help to enforce a PSO?
