Hello,

My father had received a work permit dated 19/12/2005 but had entered UK on 30/01/2006. This means that he entered UK about 40 days after his work permit started.

Now to apply for the ILR I believe he shall have to apply to extend his stay (for about a month or so). However, what I am unsure about is does he have to switch to Tier 2 now, and go through the whole process of meeting the points based criteria? or does he have to go through one of the transitional arrangements, for which I think he will have to request his employer (NHS) for the relevant documents? where he will not need to go through the points based system criteria.

Also, his visa/work permit does not really mention what category his work permit is under (he is a Senior Radiographer with the NHS), so I am not sure which transitional arrangement applies for him.

Can someone kindly clarify these issues? also is there anything else that I am over looking, or should be concerned about?

Thanks, but doesn't the Transitional arrangement imply a "transition" to Tier 2, following which he would have to apply for an extension the the Tier 2? or would it entail his extension also?
