can someone please help me, my friend has applied for ILR on exceptional circumstances and the case is currently with the home office. she has disclosed to the home office that she is working and they have not said anything to her apart from they are looking into her case.

the problem is, although she is working she is experiencing financial hardship and i wanted to find out from you guys if she is elligble to get child tax credits. one child who is 8 was born in the uk but the other who is almost 16 was born in her home country.

i would have thought as long as the child was born in the uk then surely he should be elligble for child tax credit.

misshair2010, very relevant to your question is .... is your friend living with anyone, apart from her children? That is does she have a partner or spouse, and if the answer to that is yes, please explain about the UK immigration status of that partner/spouse.

That being the case I do not think she has any way of claiming benefits ... well not until she gets ILR.

i was under the impression that child tax credit is not clasiffied as a benefit and if the child was born in the uk, is he not entitled to any help to improve his life
