Vist visa over stayer

Hi,Iam a UK citizen, My mum who is 64 years old she got a 2 years UK visit visa valid until November 2011. She left Uk after her first visit by over staying 2months ( we didnt know the 6 months rule until told by the immigration people at airport). does this revoke her visa until november 2011 or she can still use the visa and travel? what are our options? she has to do the knee surgery in December 2010 in Uk.

She may also be refused entry for 1 year since her last departure from the UK under 320(7B).

It says 180 days on the visa. I hope the knee surgery is being paid for.

Yes its a private surgery, she has the insurance.

I was thinking to sponsor her as she has no one back home,she will be 65 in january, what are the chances that she will get the dependent visa.she first got the uk visitors visa in 2004,i have spoken to few solicitors they say we can apply for dependent visa??

It's a tough test.

* you depend wholly or mainly on your settled relative for money;
* you (and any dependants you have) can and will be maintained and housed adequately, without needing public funds, in accommodation which your settled relative owns or occupies exclusively; and
* you have no other close relatives in your own country who can support you financially.

That finance test can be very hard to prove - you'll have to be regularly sending her money and showing that it's (almost) her only source of income.

Thanks, I have been told by a solicitor to apply for a short term visit visa first as she got entry in her passport that she stayed more then 180 days,do u guys think is there is a chance she will get the short term visa , or would that help if we show her medical record and the doctor appointment letter from his clinic?

You could try an application for a medical visitor:

But she may be subject to the ban mentioned above anyway.

The letter they gave her doesn't say anything about ban. The form name is ISI51A.does this letter means a ban though it doesn't say any word like ban

She will be informed of the ban when her next application is made. The case might be different if her next application is after one year of the last depature.
