hi there. apologies for asking a question im sure has been answered countless times before.. however, i am still confused and would really appeciate some clarification.

here goes...

I am a New Zealand citizen, I have lived in the U.K. for almost three years. I originally came over on a two year working holiday-maker visa. when that finished i left the country and returned later on a six month visitors visa. During this six month visitors visa, i married my wife and we applied for leave to remain in the u.k. this was refused and a lawyer informed me it would be fruitless to appeal. He also told us that it is possible for me to live and work with my wife in the e.u. After spending six months in an e.u. state we would be able to re-enter the u.k under E.E.A immigration rules. Brilliant.

However this is all background really, what i really want/need to know is can i move to Ireland (or any other E.U. State for that matter) and live and work in the counntry?
If so, what process will i have to go through, how easy is said process and what is the lilkelihood of it happening succesfully within a month?

any answers would be greatly appreciated.

Of course. If the UK citizen has been working outside of the UK for a while, they and their family can then move home on the basis of EU law. http://eumovement.wordpress.com/2007/04 ... ional-law/

And of course you can move to Ireland on the basis of EU law.

thank you for that. what are the ways i need to go about entering ireland, is it as simple as turning up in ireland with or without my wife and then going to see garda?
should i apply for a visa before leaving? what are the time restraints?
is there anything i should know before heading to ireland?

You need to travel together and with your marriage certificate. At your Irish arrival airport, you need to tell the immigration officer that you are an EU citizen arriving to work in Ireland, and that your spouse will be applying for 4EUFam (a "Residence Card").

Within 3 months of arriving, but ideally earlier, the EU citizen needs to start working. You should then immediately apply for a Residence Card for the non-EU.

Be sure to keep lots of documentation about your work and life together in Ireland. You will need these when you return to the UK, in order to qualify to enter under EU law.
