Spouse Visa Waiting Times

Post by Swannie » Tue Apr 11, 2006 7:16 pm

My wife applied for a spouse visa at the end of February, we were asked for more information ( my passport, letters from official sources etc ) which we provided in mid March. We have still not heard anything from the Home Office regarding this. My wifes fiance visa runs out on April 18th.

My question is does anybody know how long this process of getting the visa takes ? My wife is Japanese so she is not from a country where lots of bogus claims come from.

The good news is ... it does not run out! Because the application for the new visa was submitted prior to the expiry of the old one, the old one is "treated as continuing" even if its stated expiry date has passed. This is because of legislation known as "Section 3C".

The old visa is treated as continuing until they deal with the application, and (speaking theoretically here) if the application is rejected then until the time for appealing against that rejection has been reached.

The time taken to deal with the application? I suspect because insufficient supporting documentation was submitted with the application form ... that is the cause of the delay. Hopefully you will here soon.
