Preventing my partner from taking my child

Hi everyone,

I was in a relationship with a Jamaican woman who is an overstayer. We had a child together and I am named on his birth certificate. She now wants to leave the country after our relationship broke up. Do I have any legal rights over my son? I have applied for a UK passport for him, which I have been told is on the way to me. We have put in an application for her to stay in the country, but this is being cancelled.

This is an immigration-related board and effectively you are asking about a family law matter. You need to contact a Family Law Solicitor without delay, because it could well be possible for you to obtain a Court Order to prevent your child being removed from the UK. But to get such a Court Order you clearly need legal advice.

Thank you for your reply. I asked here because she will probably ask the immigration service for help getting back to Jamaica.
