Two companies at the same address

Post by taro » Sat Oct 02, 2010 11:13 pm

Hope somebody could answer this issue.

I possess tier2 general visa for the first three years and this was granted last month under a firm.
So, effectively, I have just passed only one month of my first three years. However, the company last friday announced that they would cease operations and the employees including me would be transferred to the second company (similar operations) registered at the same address under the same directors. The same directors control these two companies. However, the second company does not have the sponsorship license at the moment where as the first company does.

the second company is going to pay my salaries in future.

Can I just inform the home office that i will be transferred to the second company and keep quiet? or

Do i have to restart my visa application from the first step of the sponsorship management system under the second company.

Your tier 2 certificate is only for the licenced sponsor. If you stop working for them you have to stop working full stop. The new employer would have to be licenced, issue a new cos, you would then have to apply for new leave to remain in line with the new cos and only when that was approved could you start work for the new employer. If you started to work for them without this you could be removed from the UK for working in breach of your conditions.

I must say that this employer seems spectacularly irresponsible if they are planning to just move you to the other company. If you work for the new employer without permission they are liable for a £10k fine, as well as possibly ruining your life.

They should know all this as licenced sponsors.
