Have you obtained a Divorce from this person or a Judicial Separation.

Under ECJ caselaws, they cannot revoke your residency just because you have separated with your partner, especially if you estranged partner is still in the state exercising a treaty rights.

You will need to inform them though, when you are legally separated by way of divorce or Judicial Separation ( As in Irealand there is a concession due to the difficulty in obtaining a divorce).

Once that is done, you can write to DOJ, to apply for Retention of Rights of Residence.

Try and be Consistent in your version of event, or you might end up in a messy situation.

Hi IQU,

when describing your situation, you write:
IQU wrote:...i am married with eu citizens over 3 years we broke up 2 years ago.because i had affair with somebody...
may I remind you of your very own other thread:
http://www.immigrationboards.com/viewtopic.php?t=63193
IQU wrote:...but my wife had affair with some one else so after 3 and half years marriage she left me alone in ireland...
Without considering the change of described facts, which I think is legally irrelevant, I wonder why you didn´t continue your old thread?

Did you already follow up on the advice given there?

Regards,
Christian
