Do I have a good grounds for an H1B application?

Do I have a good grounds for an H1B application?

Hi everyone.

I want to start by thanking anyone who responds to this in advance.

I need some help:
I am currently a UK citizen, studying a Masters Degree in Engineering. I will be awarded my degree in July 2011. I have a job offer from my Uncle's company based in Texas. My uncle is a green card holder and has been living in the US for over 20 years. He is married to an American citizen and has a child.

I understand that he will have to apply for an H1B visa (I think) and file an LCA but I am confused as to timings. Ideally I want to start work as soon as possible after I graduate in July 2011.

Does anyone have any idea roughly how long this could take?

Also do you think I will be a suitable candidate for being awarded an H1B visa?

I will be obtaining a Masters Degree in Mechanical Engineering with Materials from the University of Aberdeen in Scotland. I have had 4 months work experience in a worlwide oil and gas company and have also been a 3 year recipient of their academic scholarship.

Does this hold any weight in my application? Also would including details and a reference on my research thesis for a different oil and gas company be beneficial?

You certainly sound as if you are eligible for an H1B visa. I hope your uncle is very keen on hiring you, and is retaining a good immigration attorney. Is this the case? Petitioning for H1B is not a do-it-yourself project.

Thanks for the link. Yes my uncle and I get on very well and we have worked together in the UK for periods of time. He is currently looking for a good attorney. This is the first time and probably last time that he will apply for a work visa. I might add that his company is a General Contracting company / project management. It is a small company (under 10 employees on payroll) as all work is subcontracted out. Will this make a difference in your opinion?
